YKINGS4X4 – TERMS AND CONDITIONS

These terms and conditions are between

Big Sam and Sons Pty Ltd T/A YKINGS4X4 (ABN 14651442723) (“we”, “us”, or “our”) and you, the party purchasing goods and/or services from us (together, the “Parties”, and each a “Party”).

These terms and conditions form the entire agreement under which we will provide goods and/or services to you.

1. OUR DISCLOSURES

1.1 Please read these Terms and Conditions carefully prior to making any purchase.

By accepting these Terms and Conditions, you agree that:

(a) your ownership of the goods is dependent on you paying the price, but you are responsible for the goods once delivered or collected (see clause 8.4);

(b) your failure to pay may result in us recovering or repossessing the goods;

(c) subject to your Consumer Law Rights, you have not relied on any representation or warranty not included in this Agreement;

(d) subject to your Consumer Law Rights, returns and refunds will be dealt with in accordance with these Terms and Conditions (clause 5); and

(e) subject to your Consumer Law Rights, we exclude liability for consequential loss and any liability caused by incorrect installation not performed by us.

1.2 These Terms and Conditions do not intend to limit your statutory rights, including your Consumer Law Rights.

2. ACCEPTANCE

2.1 By purchasing from us (online, by phone, or in person), you accept these Terms and Conditions, which apply to the ordering, purchase, fulfilment, and delivery of goods and services.

3. GOODS AND SERVICES

3.1 In consideration of your payment, we agree to provide goods and/or services in accordance with these Terms.

3.2 Delivery or completion dates are estimates only.

3.3 Certain goods and services may be online-exclusive or in-store only and not available in all States.

3.4 We may limit purchase quantities at our discretion.

3.5 If services are purchased:

(a) you must provide safe and sufficient access for us to perform installation; and

(b) if we attend but cannot perform due to your failure to comply, an additional call-out fee may apply.

4. ORDERS

4.1 We may refuse any order at our sole discretion.

4.2 You must provide accurate purchase and account information.

4.3 Payment must be made at the time of order or as stated on invoice.

4.4 Change-of-mind refunds are at our sole discretion.

5. RETURNS AND REFUNDS

5.1 This clause is subject to clause 9 and does not diminish your rights under the Australian Consumer Law (ACL).

(a) Any return or exchange must be made within 7 days in exchange for store credit. Products must be unused, resalable, and in original packaging. Buyers are responsible for original and return shipping costs. This also applies to orders cancelled during transit. Returns after 7 days will not be accepted.

(b) Any order discrepancy or missing item must be reported within 7 days of delivery.

(c) Change of Mind: YKINGS4X4 may refuse change-of-mind returns. Please choose carefully, as special orders or custom-made products are non-refundable.

YKINGS4X4 Manufacturer Warranty – 12 Months

All YKINGS4X4 products are covered by a 12-month manufacturer warranty against defects in materials and workmanship under normal use.

Damage due to misuse, incorrect installation, accidents, or normal wear and tear is not covered.

What’s Covered:

Manufacturing defects in parts and components

Faulty assembly or workmanship

What’s Not Covered:

Damage due to misuse, neglect, or accidents

Normal wear and tear

Modifications or alterations

Improper installation

Claim Process:

Notify us by email ([email protected]) within 30 days of discovering a defect.

Provide proof of purchase and a detailed description of the issue.

You may be required to return the product for inspection (shipping costs may apply).

Resolution:

Repair or replacement of the defective item at YKINGS4X4’s discretion.

No cash refunds – warranty covers repair or replacement only.

Limitations:

Warranty applies only to the original purchaser and is void if terms are breached.

Incidental or consequential losses are excluded.

Keep your purchase receipt for validation.

Store Credit:

Any approved refund will be issued as store credit or gift card (no expiry).

5.2 Upon receiving goods, customers must inspect within 24 hours and notify us immediately of any damage or defect before installation.

5.3 Upon completion of any service, inspect immediately and contact us by email if issues exist.

5.4 If a product is confirmed defective, we will cover return shipping costs.

5.5 For change-of-mind refunds, notify us within 7 days; refund will be store credit. Buyers are responsible for shipping costs both ways.

5.6 If a refund is issued under clause 5.4:

(a) you must arrange and pay for return shipping;

(b) return delivery costs are non-refundable;

(c) installation, wiring, or labour costs are non-refundable; and

(d) all refunds are issued as store credit with no expiry.

All shipping costs, including the cost of delivery to the customer and the cost of returning any product, are the sole responsibility of the buyer.

5.7 To cancel, refund, or claim defective goods, contact us by email with:

your order number;

reason for cancellation or refund;

and whether you seek a refund or replacement.
5.8 Returned goods must be delivered to Unit 2/10 Princes Highway, Doveton VIC 3177, Monday – Friday 8:30 am – 4:30 pm.
5.9 Risk remains with you until actual delivery to that address.

6. PRICE AND PAYMENT

6.1 Prices include GST unless otherwise stated.

6.2 GST must be paid with the purchase price.

6.3 Prices may change without notice; the price at purchase applies.

6.4 Delivery charges may vary (e.g., forklift availability).

6.5 Delivery charges are displayed in the online cart or communicated prior to purchase.

Non-Refundable Deposit and Installation Services

You acknowledge and agree that any deposit payment made to secure a booking for installation services is non-refundable under any circumstances, including change of mind or cancellation by you.

All installation-related services, including but not limited to fitting, wiring, labour, and associated work costs, are strictly non-refundable once the booking has been made or the service has commenced.

If you cancel or fail to attend your scheduled installation, the deposit and any amounts paid will be forfeited in full as compensation for time, labour, and administrative costs incurred by YKINGS4X4.

7. ESTABLISHING AND USING AN ONLINE ACCOUNT

7.1 If purchasing online, you may need to create an account unless using guest checkout.

7.2 Keep your account details confidential.

7.3 We may contact you regarding your purchase.

7.4 Registration may be refused at our discretion.

8. DELIVERY, TITLE, AND RISK

8.1 If delivery is chosen:

(a) we will use reasonable efforts to deliver to the agreed location;

(b) delivery may be affected by factors beyond our control;

(c) estimated delivery times are subject to change.

8.2 In-store purchases must comply with store policies.

8.3 For pick-up orders, you must collect at the agreed time and location.

8.4 Title remains with us until full payment is received. Risk passes upon delivery or collection.

8.5 We may repossess goods if payment is not completed.

9. YOUR CONSUMER LAW RIGHTS

9.1 The Australian Consumer Law (ACL) provides rights, warranties, and guarantees that cannot be excluded. Nothing here limits those rights.

9.2 Goods and services come with guarantees that cannot be excluded under the ACL. For major failures you are entitled to cancel and receive a refund or replacement.

9.3 Our liability is governed solely by the ACL and these Terms.

9.4 Subject to your ACL rights, all implied warranties are excluded unless stated herein.

9.5 All payments are non-refundable except as required by the ACL.

10. ADDITIONAL WARRANTIES

10.1 Some products may include or offer extended warranties.

10.2 Extended warranties are governed by the manufacturer’s terms.

11. LIMITATION OF LIABILITY

11.1 To the fullest extent permitted by law:

(a) neither party is liable for consequential loss;

(b) liability is reduced proportionately by the other party’s contribution; and

(c) our total liability is limited to resupplying goods/services or refunding the purchase price.

11.2 We exclude liability for:

(a) damage caused by incorrect installation (by others); and

(b) vehicle or property damage resulting from such installation.

12. GENERAL

12.1 We may amend these Terms at any time; updated terms appear on our website.

12.2 We may assign debts to a third-party collection agency.

12.3 These Terms constitute the entire agreement between the Parties.

12.4 Our Privacy Policy (available on our website) forms part of these Terms.

12.5 Neither Party is liable for delays due to Force Majeure Events (e.g. natural disasters, government restrictions, pandemics).

12.6 Governing Law: These Terms are governed by the laws of Victoria (VIC), Australia. Each Party submits to the exclusive jurisdiction of the courts of Victoria.

12.7 Where more than one person constitutes the buyer, all are jointly and severally liable.

12.8 These Terms do not create any partnership or employment relationship.

12.9 If any provision is invalid, it shall be read down or severed without affecting the remainder.

12.10 Use of our website is subject to our Website Terms of Use.

13. INTERPRETATION & DEFINITIONS

Business Days – days banks are open in VIC (excluding weekends & public holidays).

Delivery Location – the agreed delivery address.

Force Majeure Event – any event beyond reasonable control (e.g., fire, flood, pandemic, etc.).

Goods – products supplied under these Terms.

GST – as defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Price – the agreed price for goods/services.

Personnel – our employees, subcontractors, or agents.

Services – installation or related work performed under these Terms.

14. DISCOUNTS

Offers may not be combined with any other coupons, discounts, or promotions.
